Hours of Service Best Practices for Drivers and Shippers

A carrier arrives to pick up a load in the afternoon with only a few available hours left before he or she needs to take a 10 hour rest break. The loading facility has been running behind all day and takes much longer than anticipated to load the truck. By the time the paperwork is done and the driver is ready to go, the driver is “out of hours” and significantly into the 10 hour required rest period. The loading facility has a strict no overnight policy and asks the driver to leave. The driver refuses, reiterating that the facility is asking him to violate hours of service regulations.

On July 29, 2014, the U.S. Senate convened a hearing regarding “Opportunities and Challenges for Improving Truck Safety on Our Highways.” There were five witnesses in attendance: the administrator of the Federal Motor Carrier Safety Administration (FMCSA), the head of a leading safety advocacy group, a representative of the Teamsters, a past president of the Commercial Vehicle Safety Alliance (CVSA), and the head of safety policy for the American Trucking Association (ATA). While many topics were discussed, one primary issue was the hours of service (HOS) rules that went into effect in July 2013. Of the five witnesses, only the ATA representative was in favor of suspending the current HOS rules in favor of more study.

We’re already halfway through 2014. It’s been about six months since I last recapped three main issues that were affecting the trucking industry, hours of service (HOS), driver shortage, and the Federal Motor Carrier Administration’s (FMCSA) Comprehensive Safety and Accountability (CSA) program. Some aspects, namely the growing concern over driver shortage, haven’t changed much since then. This combination of factors—ongoing concerns, recent inclement weather, and the continuing regulation of the industry—has led to a very delicate balance of capacity supply.
